COPYRIGHT AND TERMS OF USE

Two Authors for the Same Image

Each photograph published here combines two protected works:

  • the reproduced sculpture, created by Nathalie Decoster;

  • the photograph itself, taken by the credited photographer.

The use of an image therefore involves two distinct rights holders. Authorization granted by one does not constitute authorization from the other. When the photograph was taken by Nathalie Decoster, the two rights holders are one and the same, and authorization rests solely with her.

 

Rights Held by Nathalie Decoster

Nathalie Decoster holds a right of use, granted by each photographer, for images of which she is not the author, for the purposes of documenting and promoting her work. This authorization covers publication on this website and in the artist’s promotional materials. It does not entail a transfer of the photographer’s copyright—which remains with the photographer—nor does it grant the right to sublicense to third parties.

 

Moral Rights

The moral rights of each author are perpetual, inalienable, and imprescriptible.

Any authorized reproduction must include the following complete attribution: title of the work, year, © Nathalie Decoster, © [photographer’s name].

No alteration of the image is permitted without the author’s written consent, including cropping, retouching, color correction, clipping, superimposing text or a logo, or incorporating it into a montage.

 

Use by a Third Party

The reproduction, display, distribution, making available, and adaptation of these photographs, regardless of the medium or method used, whether for commercial or non-commercial purposes, require prior written authorization.

The request must be addressed jointly to Nathalie Decoster and the credited photographer.
 

In accordance with Article L.131-3 of the Intellectual Property Code, the authorization granted must clearly specify each of the rights transferred and define the scope of their use in terms of extent, purpose, location, and duration. To this end, it must specify:

  • the visual element(s) concerned;

  • the rights granted, with reproduction and performance considered separately;

  • the media and methods of use covered;

  • the territory;

  • the duration;

  • the authorized print run, format, or audience;

  • the financial terms, if applicable;

  • the wording of the credit line.

The authorization applies only to the uses it enumerates. Any new use requires a separate application. Silence does not constitute acceptance.

Press requests follow the same procedure and are given priority.

 

Works Installed in Public Spaces

Article L.122-5, 11° of the Intellectual Property Code authorizes individuals to reproduce sculptures permanently placed on public roads, excluding any commercial use. This exception applies to photographs taken by the public itself. It does not extend to the photographs published on this website, the reuse of which remains subject to the authorization described above.

 

Penalties

In accordance with Article 5 of the legal notices, any unauthorized use will be considered an act of infringement and will be prosecuted under Articles L.335-2 et seq. of the Intellectual Property Code.

 

Reporting

These credits have been compiled with care; however, omissions or incorrect attributions may still occur. Anyone who believes that an image published here is not properly credited is invited to write to contact@nathaliedecoster.com. The credit will be corrected or the image removed as soon as possible.
